Penelitian ini menganalisis penerapan Pasal 363 KUHP terhadap tindak pidana pencurian kendaraan bermotor dengan pemberatan di Sumba Barat. Melalui metode yuridis normatif dan empiris, termasuk penelaahan Berita Acara Pemeriksaan, studi ini mengonfirmasi terpenuhinya seluruh unsur delik. Unsur tersebut meliputi pengambilan barang secara melawan hukum serta faktor pemberat seperti dilakukan bersama-sama pada dini hari. Didukung bukti saksi dan fisik, disimpulkan bahwa penerapan pasal ini secara hukum sudah tepat, meskipun masih terdapat kendala teknis terkait sarana penyidikan dan minimnya pengawasan lingkungan.
