Podcast, Pencemaran Nama Baik, dan Kebebasan Berekspresi: Tinjauan Kritis Hukum Positif di Indonesia

Keberadaan dan maraknya platform podcast di Indonesia membuka ruang baru bagi kebebasan berekspresi, tetapi di sisi lain menempatkan podcaster dalam posisi yang rentan terhadap tuduhan pencemaran nama baik. Penelitian ini bertujuan untuk menganalisis pengaturan hukum mengenai pencemaran nama baik terhadap podcaster serta menilai apakah mekanisme penegakan hukumnya telah selaras dengan prinsip proporsionalitas dan kebebasan berekspresi. Artikel ini menganalisis bentuk perlindungan hukum yang seharusnya diberikan kepada podcaster berdasarkan Kitab Undang-Undang Hukum Pidana, Undang-Undang Informasi dan Transaksi Elektronik, serta prinsip kebebasan berekspresi dalam hukum nasional dan internasional. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan studi literatur. Hasil penelitian menunjukkan bahwa penegakan hukum terhadap dugaan pencemaran nama baik dalam konten podcast berpotensi belum sepenuhnya mempertimbangkan konteks komunikasi digital dan prinsip proporsionalitas. Oleh karena itu, artikel ini menegaskan perlunya kerangka penegakan hukum yang lebih kontekstual dan preventif guna menjamin perlindungan kebebasan berekspresi tanpa mengabaikan hak atas reputasi pihak lain.
