Dinamika Pembagian Waris dalam Masyarakat Bima, Ntb: Suatu Kajian Literatur Sosio-Legal

Penelitian ini bertujuan untuk menganalisis konsep dan praktik pembagian waris pada masyarakat Bima, Nusa Tenggara Barat, melalui pendekatan studi literatur terhadap berbagai sumber primer dan sekunder seperti buku, artikel jurnal, laporan penelitian, serta dokumen adat lokal. Literatur review ini mengidentifikasi bahwa sistem pewarisan masyarakat Bima merupakan hasil perpaduan antara hukum adat Mbojo, ajaran Islam, serta pengaruh modernisasi hukum nasional. Dalam tradisi adat Bima, pembagian waris cenderung berorientasi pada prinsip kekeluargaan dan musyawarah, dengan pola pembagian yang tidak selalu sama dengan hukum Islam maupun hukum perdata. Temuan utama menunjukkan bahwa nilai-nilai lokal seperti sara ro tora, penghormatan pada anak tertua, dan peran keluarga besar masih sangat menentukan proses distribusi harta warisan. Meskipun demikian, terdapat pergeseran praktik akibat meningkatnya pendidikan, interaksi sosial, dan penggunaan hukum negara dalam penyelesaian sengketa waris. Studi ini menyimpulkan bahwa dinamika pembagian waris masyarakat Bima mencerminkan proses negosiasi antara adat, agama, dan modernitas. Penelitian ini merekomendasikan perlunya dokumentasi adat waris Bima secara lebih sistematis serta kajian empiris lanjutan untuk memahami praktik aktual di masyarakat masa kini.
